Nevertheless, in some cases, such as the aforementioned cases, the Commerce Clause seems to have been a sufficient basis to withstand the First Amendment.

The Commerce Clause of the Constitution may be a formidable ally when it comes to online gambling, but there are plenty of other considerations to be considered as well. An example of these concerns is the First Amendment’s guarantee of free speech.
